Legal Question in Family Law in California

child father

am pregnant, married, but father of child is not my

husband. will have father on birth certificate. does father

have to adopt child once i am divorced and we can get

married? can i give the child the last name of the father,

although my last name is hyphenated, my maiden

name + my married name? so the child would have an

entirely different last name, than i do?

Re: child father

The answers to your questions are probably yes. However, if you are currently married your husband may be the presumed father. That presumption may be overcome, however, that is not an issue on which you want to make a mistake. I suggest that you et the advice of an attorney, because you have two men who you must deal with to accomplish what you want. Good Luck, Pat McCrary
