Can I take my child with me?

Hi! I live in California and I want to know whether or not I can take my child with me if I leave my husband. He says that it is against state law because this (where we live now) is her legal residence and that she would have to stay until custody was decided. I will have a place to go where we will have a room of our own so I don't see why I would not be able to take her with me. If I left I would file for custody prior to leaving anyhow.

Please let me know what I can do?

You can take the children when you move out. Just be sure that either he knows where the children are living, unless there is domestic voilence. If there is domestic violence then you should contact the local police and batter women's shelter. This will allow you move safely from the family home. Then file for a domestic violence restraining order.
