Legal Question in Family Law in California

If a child is living with me with consent form the legal parent, and i go to court to gain custody, through paternity. Will the child be taken out of both our custody and placed in foster care.

You should file for a paternity test to see if you are the parent of the child. If that is the case then you may be able to petition the court to be designated the parent of the child prior to any judgment of paternity being made. After the judgment is made it is more difficult to establish a different paternity.
