Legal Question in Family Law in California

i have a child with someone i was never married to. My child has my last name but i would like to have the court change it to his mothers last name since i was never married to her, i have joint custody, visitation, and pay child support. can i do this

Roach is wrong. If you have joint legal custody neither of you can change her name over the objection of the other. Only if the mother agrees will you be allowed to do it.
