Legal Question in Family Law in California

child not mine

mother gave child to me at 6months old. Told me to raise him till she got her life together. 14 years later I still have the child. Before she gave up the child she had put him on welfare. Found this out when child was 4yrs old when they tried to garnish my wages. Proved to them that child was living with me and they cut here off. State picked up case and started charging me again later. Had several meetings with them to explain what happen but they still are charging me for support. Now I owe 70,000 in arrears. At the meeting I had last month I was told to file for sole custody of my son in court. Listening to my now girlfriend I had a paternity test done. Test came back last week ................the child is not mine. Am I screwed bigtime??????

Re: child not mine

No you are not, but you must talk to an attorney to work this out. Child support enforcement changed from county collection to state collection last year and they have picked up an old case. You may have a judgment against you and you will need to bring a motion to set aside the judgment or have the arrears enforcement reduced to $0. You should have an attorney because as you can see making a mistake can cost you 10's of thousands of dollars. Good Luck, Pat McCrary
