Legal Question in Family Law in California

child missing

My son went on a field trip to knotts berry farm with a summer camp program. They told us that they saw him at 5:30pm at the meeting place and saw him get on the bus at 6pm. My son was not on the bus when they arrived back to the summer camp. When his dad didn't see him get off the bus he immediately told the staff member his son didn't get off the bus. They said, we just saw him get off he is probably in the restroom. When they found out that he never made it on the bus they didn't know what to do, they were just standing not knowing what to do.Finally, the supervisor comes and things start moving. My family had to call the Buena Park PD, let them know the situation they immediately called Knott's. My son had been missing for about 1 1/2. When he didn't see his group he looked at his watch it was 4:49pm with no luck in finding his group he aproached a security guard and they admited him in at 5:30pm. We didn't find out where he was until 8pm. A staff member approached my 7yr old son and told him why didn't you make sure your brother wasn on the bus? My sis arrived at Knott's,my son was afraid & told her that he thought he was never going to see his family again. What if? What if someone took him? all these things r in my head!!!

Re: child missing

Thank God your story had a happy ending, some do not. The summer camp had a duty to make sure your son got on the bus. Theoretically you could sue them for negligence. But nobody was hurt, so your damages are minimal. And you probably signed a legal release for the field trip (which might or might not hold up in court). You could sue in small claims court for up to $5000 or contact a local attorney in person for better advice based on more facts.
