Legal Question in Family Law in California
Child and spousal support arrears
Last year we went to court for a modification (my ex presented his military LES) A few months later he retired, but did not resubmit his retirement pay. A court order for spousal and child support was issued based on his military pay. I went to child support to collect and they have started garnishing him at his new job. Now his is asking me to sign a stipulation stating that he does not owe me the arrears of over $16,000 dollars because the court went off the wrong numbers. Do I just let DCSS handle the issue with him?

DCSS does not represent you...there is no attorney client relationship. Do not under any circumstance sign any waiver without seeking the advice of an attorney.

I would yes. Even if the support numbers should have been lower, he didn't go to court to change them. He's stuck with the arrearage and can't do anything about it. You control the issue. Only you can let him off the hook.
