Child support

I was on AFDC, and I know if I file for child support the father will have to pay that money back first. But will I get anything while he's paying this money back or will my payments start after he's done paying the government back?

One more question the father is a real con artist I know if I take him to court he'll come with fake check stubs, fake rent receipt, fake child care receipts for his other kids. How do the courts in California check income I hope the use your social security number.

What you will get in child support depends on a lot of factors including your respective incomes and so forth. There is no way to tell you without having all of the information.

If this man brings fraudulent pay stubs and other documents to court and presents them as authentic in order to defraud the court and have his child support reduced, he will be committing felony and will have bigger problems than paying his child support.

The court would make an order for current child support and an second order for an amount to be applied to the arrears. You would recieve the court ordered on going support would be paid first then any excess would be applied to the arrears. The child support enforcement department should assist you in obtaining accurate records of his income and child care costs. In addition they should assist in enforcing the support order.
