Legal Question in Family Law in California

Child support arrearages

This regarding the orders for support in 1996. They state that in addition to the monthly support, 28% of any bonuses, commissions, vacation or sick pay will be paid quartlery to the ex-spouse.

My husband now makes considerably more money now than he did in 1996.

The ex-spouse is now suing for $50,000, stating that the 28% should have included any amounts over his base pay at that time, including raises.

There is no mention of paying 28% of any raises received. Is there a law in effect that makes that clear one way or the other?

Thank you

Re: Child support arrearages

No. However, $50,000.00 is a lot of money. Why haven't you retained counsel to help you in this and to represent you in court????
