Legal Question in Family Law in California

Child Support Arrears Only

when requesting arrears only on a closed L.A. county child support case, do I submit a motion to change the initial judgement and serve the court and the non custodial parent or is this considered a brand new judgment? Non custodial parent agreed in writing to pay the arrears, so that I could assist our son with college expenses. Our son started college in September and the payments stopped in October. Really need help.

Thank you.

Re: Child Support Arrears Only

You enforce in the original action. You may need to file a motion to set the amount of the arrearages. You can then get a wage assignment. There are other remedies that are available to you. Good Luck, Pat McCrary
