Legal Question in Family Law in California

Child support Arrears

I spent two years in prison for drugs and could not pay court ordered support of 550.00 per month. The D.A kept sending me a payment notice while in prison of 550.00 each month. Is there a law that states I should pay what a person on unemployment should have to pay because I was unemployed. I requested that they lower my payment amount until I get out of prison and go back to work and they would not do it. I now owe 12,000 for the months I was unemployed. Is there a standard on what I should have to pay? Can I settle with them now that my children are over 18 years? I have been paying like clock work for the last 9 years. How might I settle with them and get on with my life? Please help. Thank you.

Re: Child support Arrears

The court cannot reduce child support after the fact. You do not say whether the support is owed to the county to repay for AFDC or is owed to the mother of the children.

Either way the best bet for settling a case such as this is to offer a lump sum payment, as full settlement.

You should contac an attorney with all of your documents to see if there are any other possibilities.
