Legal Question in Family Law in California
Child Support Arrears and tax refunds
My "ex" owes thousands in child support arrears. I have filed the case with the District Attorney. Months ago, my "ex" was notified by the DA that his tax refund would be mailed to me and be credited against the arrears owed. I hear via mutual friends that he is not going to file for his refund because he doesn't want me and his daughter to have it. He should receive in the area of $3000 or so. Is there anything I can do?

Re: Child Support Arrears and tax refunds
If your ex has an income or other assets to generate a $3,000 tax return, there
would seem to be assets against which to execute your arrears judgment.
With respect to the return, if no return if filed, you could report your ex to the IRS/State
taxing authorities.
