Legal Question in Family Law in California

child support

I had back surgery in july and recently found out I was pregnant. My son who is 16 assulted me and was taken into juvinile hall. The judge asked my mother if he could stay with her instead of going away because he has a history of assult and a anger problem. the judge thought it was best for my health and wanted us to work on the relationship ship while he is at my mom's temporarily. I see my son everyday and take him to school. He also stays with me sometimes during the week or weekend. I pay for all of his food, medical appointments, medications, activities etc..his father who never see's him and lives out of state now feels he should not pay me child support and that I should pay my mom. My mon allows my son to stay there for the time being and does not support my son financially. Can my ex husband get out of paying child support to me and will I have to pay child support even though I do completely support my son not my mother? If someone can answer this it would really help.

Thank you,

Ruth

Re: child support

Unless there is a provision in the court order excusing the payment of child support when he is not physically living in your home he is liable for the payment of child support. As to your payment of child support you are supporting your child, by paying his living expenses.
