Child Support in California

My sister and her husband have one son. They live in California. They are currently separated. She has him most of the time. He has him when she's at work. He doesn't pay child support neither does he give her anything for their son. She makes more money than he does. But he doesn't contribute anything financially for their son. Can she sue him for child support? She's afraid that if she sues him, that he'll sue her for alimony. He's left the house that they share and she now pays the mortgage, he has cars and a motorcycle. She's struggling to pay for tutoring for their son, the mortgage, and for transportation. What are her rights?

Her rights are many, as well as her responsibilities. The issues are too complex to give you an answer that has any credibility. I suggest that she talk to a family law attorney so that he can obtain all of the relevant facts. She could be right that she would owe him money. Good Luck, Pat McCrary
