Child Support

I have 2 children. I child got kicked out of the home so I deducted the child support for that time. Can my wages be garnashied?

The answer would depend upon the specific wording of the child support order and where the child is currently living. Get a consultation with a family law attorney to go over the specific facts of your case. You might want to file a motion, but that could result in an increase in the support amount. You will need to know the current guideline support amount for one child before you make a decision to make a decision concerning whether to file a motion. Good Luck, Pat McCrary

If there are court orders in place then you must follow them. If circumstances have changed then you need to file the appropriate OSC or motion with the court to have the orders modified and the wage withholding order changed.
