Legal Question in Family Law in California

Child Support Closed Cased

I am/was custodial parent of three kids from birth to 21 years of age. When child support order was made court gave other parent rights to claim kids in his income tax and not me. I was audited by IRS and is a closed case now. I want to reopen the case and talk to judge about which I believe court made a mistake on this. I want to have the rights as a single parent to have claimed them. IRS is garnishing my wages because of this and I believe the court made a mistake. I can proof that I was the custodian parent as well as my kids that are grown now. The other parent never talked to me about this and he gets away with it. My question is can a closed case be reopen and reevaluate it for correction.

If all of the kids are 21, then it would appear that the case is too old to reopen. You should take your last order to an attorney to get a more definite answer. Good Luck, Pat McCrary
