Legal Question in Family Law in California
Child Support Collection
My exhusband owes me over $40,000 in child support and will not pay. The amount is constantly ticking up monthly. The DA is doing nothing to see that I'm paid. How else can I collect these monies owed. Can I have him arrested due to non payment. I cannot find out who he works for because he's working under someone else name and using alias and there is no paper trail. He lives in a $700,000 house purchased with money he's made but he put it in her name or the companies name and there is no paper trail. I am tired of fighting the DA because I get know where. I haven't received any money in over a year. Can you give me some direction or some other option as to how I might collect these monies.

You should consult an attorney for assistance in getting information about his assets. A private investigator could get information about his employment and check the title to the home he is living in. You could also request copies of this income tax returns.

The options you have are the same as any attorney or collection agency would use in locating and collecting what is rightfully owed to you. You may learn to do skip tracing on your own, or you may prefer retaining the expertise of an attorney who specializes in such collections from "difficult to locate, deadbeat debtors". This is alot of money you have at stake, so definitely weigh your options, including how quickly you may want to be paid out on this debt when deciding to try to do it yourself or retaining a professional. Unfortunately, as you astutely realize as well, the DA's office is typically swamped with various cases and such governmental agencies cannot always give top priority to each and every case that is filed. However, that is the great benefit of private attorneys who work alot more efficiently, effectively and expeditiously on the behalf of their select clients.
