child support while child is out of country

My son, 16, will be leaving at the end of January on a foreigh exhange student program for six months. The cost of the program is $7500 which covers school and living expenses while he is there.(approx $800 is attributed to airfare) I am willing to prepay my support payments for the six month period so he can use this money. His mother refuses to cooperate, saying she needs the money for her mortgasge payment. He also lives with me 50% of the time. Can I have my child support payments suspended while he is gone? I will then pay him directly.

That is an issue that will need to be determined by the judge. It is clearly in his discretion and you should file a motion immediately. You should obtain an attorney on this so that the issue can be presented properly to the court. There is no law or case that is directly on point. Good Luck, Pat McCrary
