Legal Question in Family Law in California

child support

My ex and I went to court. A private child support order was filed 3-19-09. He is to pay $1150.00 per month for his two kids- they live with me. It is not specified in the order that the support amount includes daycare costs. Since the order was filed he has payed approximately $300.00 directly to his sons daycare, which i verbally agreed would be okay, and I have received $200.00 cash. and b/c his hours at work have been cut he has decided he should come to my house to watch our son while I work so he doesn't have to pay the daycare. Can he chose to keep our son home from daycare when he isn't working? He says it's either that or he won't be able to pay the daycare. What should I do? Do i go to DCSS to have the childsupport enforced? I feel like he is getting off easy. The guy makes $53.00 per hour and only has to work two or three days a week to make his bills.

I would file for a wage assigment so you don't have to worry about him paying you when he decides on it. It will make collection much easier for child support.
