Child Support and Custody

My bf has physical custody of his 11 year old son. His sons mother is suppose to see him every other weekend. Only problem being that she is not consistent, whether it be coming to get him at 10pm on Fri or just not getting him at all. We tried reasoning with her to no avail. But we think if we get some type of court to say these are the specifics of the visitation and you must adhere to it that it would make her more consistent. We just do not know where to begin.

Your first step should to talk to the other side and see if you can work on a custody arrangement. Another option is to consult with the family law facilitator of your local county for self help advice. An OSC to change custody would be in order.

You should file a motion to modify the terms of the visitation. Ask the court to set the start time of the visit and then give her 15 minutes after the start time to arrive or the visit is canceled. That will stop the late night pickup for the visit.
