Legal Question in Family Law in California

Child Support or Custody first?

I will be going

to court for child support. I have two children who has been here

for a year from a foreign country. When I divorced my ex-wife,

custody was not established because the children were out of the country

and the courts had no jurisdiction over them. Now they are here, and

my ex-wife is taking me to court for child support. My question is

should I settle the custody first before the child support, or should

I settle the child support and handle the custody at a later time. I

was thinking to settle the custody first since I know child support

is somewhat based on custody. Any assistance in this matter is truly

appreciated.

Thank you

Re: Child Support or Custody first?

The procedure most likely to be followed by the court is to set temporary support pending the results of the petition for change of custody and visitation. Therefore you should petition the court for the custody change as soon as possible.
