Legal Question in Family Law in California

Child Support -

I have a daughter from a former marriage who just turned 18 years old. Her father did not pay child support for five years due to unemployment. He is married. I opened a case with the Child Support Bureau and managed to get his attention when his licensed was denied. The D.A. calculated the amount of "back child support" was over $27,000. I thought this was so much that I would never see it and so I reduced it to 5,000. For the last four years he has paid me $50 per month on the back child support and $200.00 per month for her support. However, he recently made it clear to me he did not have intention of paying anymore as she was of age - even though she continues to go to school and we of course have run into other financial situation where we are lacking monies. The agreement he and I came to was a letter agreement and I had (four years ago) called the D.A. to inform them we had settled our case. What can I do at this point since she is an adult? Thanx!

You are entitled to collect arrears just like any other money judgment.

Attorney Fernandez is right...and, there's a new case which held that you can collect on your judgment many years later, even after your daughter is older. Of course, you probably could use the money right now, so contact an attorney right away if the DA's office isn't being of much assistance. Depending on your prior agreements, you may even be able to collect the full $27,000. You can probably also get an automatic wage withholding for the money you're owed, so you don't have to worry that your check won't arrive. Good luck!
