Legal Question in Family Law in California

child support

my daughters father has been paying or sometimes pays $200 a month in support and does not provide medical or any other support and still says he can claim her every other year at tax time. Is this what the court will tell me if i try to get that changed in our divorce decree? Or do i have a chance in changing that to me claiming her every year?

Re: child support

The IRS will consider the amount of time the child is in the custody of each parent. The court will also consider the time share of each parent. The amount of child support actually paid may also come into consideration with the court.
