Legal Question in Family Law in California

Child Support for a dependent child 18 yrs old

I have been receiving child support for my son since my divorce in 1990 when he was 6. I asked for support until he turned 18 not realizing he would turn 18 at the beginning his senior year in high school. He lives with me 12 months a year and I provide over 50% of his support. His father has never missed a payment but wants to stop payments at age 18 regardless of his high school status. Do I have any legal right to child support until he graduates from high school even though he turns 18? The divorce occurred in Colorado and we are currently living in Calif. (we've been here 3 years). The father lives in Colorado. Thank you.

Re: Child Support for a dependent child 18 yrs old

California law makes the parents liable for the support of their children until they are 18 years and have graduated from high shcool or 19 if they are still enrolled in highschool. At age 19 the statutory obligation to support a child ceases. However the moral obligation continues to exist.
