Legal Question in Family Law in California

child support and disability

My child support was determined while I was working. I have become disabled. I am therefore not making close to the amount of my earlier income. Must the DA consider this when I ask for a modification. Or do I have to follow all of the legal hoops like anyone else. I no longer have the money nor ability to fight them as before.

Re: child support and disability

without knowing your particular situation, the general route in addressing a change of circumstances within an existing court ordered child support settlement would be to schedule what is called an OSC hearing to present the very type of evidence to justify a modification in your support payments now. in can be done in an affordable in pro per manner with attorney assistance as well if you do not want the expense of retaining an attorney for actual appearances or representation. if you would like further assistance in this matter, email us directly today.
