Legal Question in Family Law in California

child support for disabled son

hi , my son just turned 18yrs. is out of h.s. says he will go to college but....to busy partying. He has been deemed disabled (depression and anger problems)and takes meds.He was put in an institution for 2yrs for trying to kill his mom. His mom dosent collect SSI that I know of but has recently looked into it.What are the laws in Ca. regarding this, do I still have to pay child support? We have an agreement that if she needs something above the monthly support that she would just ask instead of taking me back to court again and again. I really dont want to have to give a set amount anymore. Would I have to go back to court? She has full custody and he comes over when he wants something, but because of his behavior and drug/alcohol issues I dont want him to live with me and my new children. thanks for all your help.

Re: child support for disabled son

If your son is disabled and unable to support himself both parents have a duty to support the son. This means he is unable to work at any job, including the car wash. Good Luck, Pat Mccrary
