Legal Question in Family Law in California
Child Support Division
I am wondering how supporting a child should be split between the parents. I live in another state and am not able to spend any time with the child so the mother has her 100% of the time. What I am wondering is if all the child's expenses should be split roughly 50/50? Of should I be paying all the expenses for the child because I don't spend any time with the child? I am referring to basic living expenses such as clothes, food, daycare, etc. Thanks!

Re: Child Support Division
If there is no court order in place, there is no set amount or percentage you would be required to pay. However, should the custodial parent seek a court order for support, the court will use a computer program to calculate support. The two most important imput parameters of the calculation are income and percentage time share. If you have 0% time share, then the income of the custodial parent is for the most part irrelevant--you will pay the same whether the custodial parent makes $0 or double your income.
