Child Support

I am divorced with a child support award,if my ex-spouse re-marries, will he and his new wife be responsible for child support payments? Can her wages be garnished for this debt if he has no tracable income?

Re: Child Support

As a general rule the new spouse's income cannot be attached to pay for child support. The only affect that the new spouse has on child support is the amount of taxes paid. There are may be some individual circumstances under which the new spouse income could be attached for the payment of child support.
