Legal Question in Family Law in California
child support
My ex-husband has informed me that he will no longer give me my child support payment of $1000.00 a month. He claims that he only has enough money to make his house payments for six months and does not want to pay me anymore. He owns his own business and has all his bills for his car, credit card, gas and food paid though his business. Child services says they will ask for his pay stubs and tax returns to get support, but he has been hiding his pay through cash payouts and claims he only made $8000.00 last year and has not cashed a paycheck in a year. I have lost my job. How do the courts take into consideration a person claiming to make $8000 a year but has living expenses of $60,000. Will an internal audit of his company be used in determining his child support payment? What is entailed in getting that audit and what recourse do I have in the meantime?

Re: child support
Enforcing your support order against a self-employed individual can be very difficult. Although the people employed by Child Support Services Department are good people doing a good job, the workload and budget is such that they have neither the time or the resources to effectively go after a self-employed individual.
I have been an attorney in Family Law for over 20 years, the past 16 of which have been devoted to enforcing past due child and/or spousal support orders. There are remedies available to you.
