Legal Question in Family Law in California

child support

my ex-husband is a police officer he has been paying same child support except for one increase. my daughter is now 18 I have had sole custody since our divorce. she's in college now and stays on campus. I pay for everything, I don't make alot of money but, have managed. He has moved up serveral time in thre ranks. He's now a seragant. I told him I was going to take him back to court if he didn't help with college. He agreed because he doesn't want me to know how much he really makes. He gave me $375.00 and I stll get support which is $150.00 bi-weekly. He since changed it and the last few checks have been $38.00 twice a week. My question is. Can I take him back to court because he made a verbal agreement? Can I take him back and get back fees when is pay was increase each time. I have a son that is his child also but he's 20years old now. But, he has 6 children total 3 minors and another one on the way.

Thank you very much. This is only child that ever went to college. Wouldn't you think he would like to help!

Re: child support

Obviously he does not want to contribute to her college expenses. It is unlikely that you can enforce a verbal agreement to pay for her college expenses. There is no statutory obligation for him to pay her college expenses. Further discussions with him may be more fruitful than court action. Depending upon the relationship between father and daughter she may be the most successful in obtaining financial assistance.
