Legal Question in Family Law in California

Child Support - Father gets paid cash for jobs.

When my husband and I divorced over 10 years ago, we saw a mediator and agreed on $400 a month in child support. For the past 3 1/2 years he has only paid me sporadically. He owes me a total of almost a year's worth. I have not filed with the court because he work (construction) pays a lot of cash jobs and his boss is his friend. I know he will claim a very low income. I have a pretty decent income and pay for my son's health insurance and all expenses. He spends about 30 percent total with our son. Is it worth it to take him to court? I live in San Diego.

It is worth taking him to court if you want and need the money. You agreed upon the monthly sum for a reason- need.

The best approach in these cases is to run a dissomaster through an attorney or some other source. This will give you a better idea of the possible results of going to court. Sometimes the amount of child support is reduced rather than increasing the amount.
