Legal Question in Family Law in California

child support

My Fiance and I live together and have a new baby , his ex-wife is threatening to get more child support from my fiance because she now claims that she can add my income to my fiances and get child support based on both of our incomes. Can you please tell me if that is legal, and if it is not now, will it be once we get married? Thank you for your time.

New spouse income is not used to increase his support obligation. New spouse is put into the support program to determine if it reduces or increases the income taxes he pays. higher taxes result in lower child support. Lower taxes result in higher child support payments.
