Legal Question in Family Law in California

child support

My fiance pays child support for a 9 year old son. (1) Can mother re-petition for more money based on my additional income when we marry and/or because the child is now older? (2) Is there a child support table that gives you an idea of what you will pay based on your income in California? (3) If you pay child support and have court visitation, can the court force visitation?

Re: child support

The income of the new spouse is not used for paying child support. The only affect is the tax status of the paying parent. Many times that would mean a reduction of child support payment, which logically makes no sense but is does work out. There is no table because it is a formula. Visitation can be enforce by the court in many different ways including a change of custody if the custodial parent denies the visitation. Good Luck, Pat McCrary
