Child support fraud

During our Divorce my ex wife file for support from the state. I had court ordered custody of our son during the divorce, and primary custody after the divorce. At no time did see have custody other then visitation. The state paid her for the 3 months that she did not have our son. Now the DA is coming after me for that money. What can I do?

This is easy. Need to file a motion in family law court, to determine arrears. you have a great case will not owe anything. Must do extensive declaration and attach exhibits. You need to provide the DA with a certified copy of the custody order, and support order if any.

Also provide the DA with a list of witnesses that know where you child was living during that period of time.

I have had clients that have done this and the DA went after the other parent for velfare fraud.

That may or may not be the case here. You should however present that evidence to the DA and let the DA decide what to do.
