Legal Question in Family Law in California

Child Support

My husband currently has minimal custody of his daughter. He paycheck is being garnished for the weekly child support he owes. The mother is not receiving these moneis from the state and has since, in the interim, asked for him to pay child care. Shoul dhe still pay the child care though the money is being deducted from his paycheck weekly and she will receive any past due amounts from tax refunds?

Re: Child Support

If the mother puts the child in childcare because she is working, then both parties are eqully responsible for the costs. Whether, it should probably be paid through the wage assignment to prevent future problems. There is also a limit to the amount of money they can take each month.
