Child Support

My husband has an 11 yr old son who lives in CA with his mom. Prior, they lived in PA. My husband is beign charged child supprot by both PA and Ca. Is that legal, when the child now resides in Contra Costa County Ca? Can you recomend an attorney in Contra Costa County to handle this? Thank you

Child support for a given period of time may be collected by only one state. However, in your husbands case the support being paid to Pennsylvania maybe for arrears, that is child support for the time the child was in Pennsylvania and child support was not paid.

You need to obtain an accounting for the child support that is being requested in both California and Pennsylvania. If they are for the same time period than you should go to court to obtain an order stopping one of the support orders.

Also, it may be that State A is going after him at the request of State B (not a duplication of months as such, but perhaps because State B is not getting what they are entitled to, and he is now in State A) not additional support, merely seeking the old support. The other obvious possibility is that this is a bureacratic screwup and since Cal is one of the states involved, that is extremely likely. Get this cleared up as soon as possible.
