child support- income tax

my question is can mom make me

paid her back for claiming our son on

my income tax return? we both had

him 50/50?, the D.A. told me that i

might have to pay back the money i

had received for the past five years. i

don't understand why when i had

him 50% of the time AND was

paying cild support.

No. But the IRS can examine your returns and make an adjustment if you didn't have the right to claim your child. Talk to your tax preparer. There is a simple analysis to follow to determine who gets the deduction.
