Legal Question in Family Law in California
child support increase
How do I increase child support payments without going to court? My ex-husband is paying less than he should be expected to pay and will not increase the amount. My two children are getting older and have more needs and his salary continues to increase but he will not increase support. He is paying the agreed amount from 4 years ago but that amount was less than the amount figured by the courts.

In a general sense, there is no way to force him to pay more support other than going to court and asking for an order. You are entitled to a guideline child support order which is based upon both parents current income.

If he does not agree the only alternative is to go to court. There is a good chance that the court would order him to make a contribution to your attorney fees. Good Luck, Pat McCrary
