child support interest
Divorced in 1987. In 1997 calif. went BACK ten years and added over $10,000 in interest on child support arrears. Can they do this? I have proof they did this. HELP PLEASE!!!

I would recommend consulting with a family law attorney licensed in California. Although you live in Washington the applicable law and location where it is being applied appears to be California. If the other party registers the order in Washington under the Uniform Interstate Family Support Act there may be issues to address here, but I don't understand that to be the situation.

California statute provides for the accumulation of interest at the rate of 10% per annum, simple interest, on all unpaid judgments, including child support judgments.

Was there a support order in 1987? The D.A. can enforce a judgment in this manner - but there has to be an order/judgment to enforce.
If you would like assistance, please Call my office or email me at [email protected]. If they are going back ten years, there are a number of things you can do such as compromising the amount owed. There is a new statute effective 1/1/2005 regarding arrears and the ability of the D.A. to go back - I would need more facts to see if this applies.
