Legal Question in Family Law in California

child support issues

If my ex decides to stop paying support due to the fact that she hasn't lived with me for awhile (about 3 years and she is 17). I occasionally see her too. I also haven't spend any of the money on her either. He does buy her clothes, pays the medical/dental and also bought her a car. He pays for everything. The amount that I recieve is $200.00. Is it worth the time and money to pursue and if I decide to fight it do I have to do a financial form and does my husband's income count? or will I end up paying him support?

Re: child support issues

If you pursue him, you may end up paying him support. He also may have an equitable defense since he is providing the support directly to her. You should have your entire situation reviewed by an attorney. Generally, if you only occasionaly see your child you will probably end up paying him support. You shouldn't ignore the situation, but get a consultation with an attorney who can discuss your situation with you in more detail. Good Luck, Pat McCrary
