Legal Question in Family Law in California
child support issues, ie... levies on monies in bank accounts.
ok, couple of issues, im a father of two boys age 16 and 10. Their mother and I never married, but have remained together,(off and on) throughout the childrens lives,(with slight separation periods), Never the less, we are together as of today. For a period of approx. 15 months back in Feb. 2003 we split and she went with friends. unaware she went on state aid im now faced with some back child support issues to the tune of approx. $13,000. In the time we were apart I always took care of my childrens needs as well as gave their mother money for support, problem is i cant prove the monies given to their mother as cash was always involved as we were still together even if we werent living with one another. I know, OOOPSS!! Cant prove a thing xcept whatever monies was spent on children as im sure the will attest to the fact that theyve never gone without. now we are living together again and sounds like i still have to continue paying child suppot to la county and we live together, whats the prob here? and is there anyway possible that child support will work with me on this massive money seizure amount? as i was awarded monies from a relatives death as was going into a fund for children. Thats my story and im sticking to it. thank u

Unfortunately, since the children were on state assistance, there's not much you can do. Federal law prohibits the state from doing anything but collecting repayment of the assistance paid. Even proving fraud is not a bar to collection. The state wants the money back that they paid, they don't care what source is paying. If you could prove you provided support during the time, they may take a look at that, but you do not have the proof, as the payments were in cash. Sorry!
