Child support /job layoff

My boyfriend's company has given him a 60 day layoff notice

and a modification of child support has been in process since Oct.2001. He is now paying, per divorce agreement, $167.00 per month, and was prepared to pay the guideline amount that would probably have been awarded to his ex. Since his income will be greatly reduced from when he submitted his income report to the DA, will the judge use the original income amount submitted? How or will unemployment effect the proceedings? He has already informed the DA. Thanx for your input.

The judge will use the unemployment to calculate ongoing child support, may calculate child support retroactive to last October based upon the actual earnings during that time and will probably order your boyfriend to make job contacts looking for employment and then set a future hearing to review the job contacts and then set child support based upon his income when he obtains a job. $167 is very low for child support and he may expect to have an increase, even when he is on unemployment.
