Legal Question in Family Law in California

child support from jobless dad

What can the custodial parent expect if the non-custodial father,

who's been paying minimal child support for 2 years, quit his job.

He's homeless, and is in debt to the IRS as well. There may be

hidden assets, but is it worth the court costs to go after them? My

husband and I both have fairly well-paid jobs to support two

children, though he resents my ex's criminal past and getting away

with not supporting his children.

Re: child support from jobless dad

As you are probably well aware, it is very difficult to "get blood from a stone." If the child's father quit his job rather than being fired, the court may impute an income to him for purposes of child support computation. However, if he is homeless and is without funds, it may not be cost effective to pursue the matter through an attorney. You should probably contact the Child and Family Suport Services to pursue the matter at no cost to you. Otherwise, you should speak with an attorney for legal advise which can only be given when all the facts are available.
