Legal Question in Family Law in California

Child Support Labilty New Spouse

Can an a arrangement be made prior to marriage that would allow me to be exempt from any of my spouses financial obligations? I don't want to be responsible for his child support or back debts? Is such an agreement legal and binding?

Re: Child Support Labilty New Spouse

While you technically might not be liable for your future spouse's pre-marital debts, the situation gets clouded if you have joint accounts after marriage, etc. I recommend you have a prenuptial agreement drafted by an attorney experienced in this area of the law. The more separate you keep your finances from your future spouses, the safer you will be.
