child support limitations

What is the statute of limitations on collecting back child support? I located my father after over 20 years. The divorce and subsequent support ruling occurred in Massapequa, New York. Both my father and I now live in Southern California.

There is no statute of limitation for your mom or the County to collect support. You have no right to collect support unless your mom or the County assigns that right to you. Should your mom be deceased, You may have the right to collect the money as an heir of her estate, but you may have to open or reopen a probate. You would also need to have the support judgment registered in California so you could enforce it here.

There is no statute of limitations on collection of child support. However, it may not be you who can enforce the award unless the support was ordered payable to you. Generally, that would be your mother. Good Luck, Pat McCrary
