Legal Question in Family Law in California

Child Support After Marriage Nullity

My husband, without my knowledge or consent had our marriage nulled, but we reconcilled & 3 years later had a child. Within the year, he again left. I asked the court for child support documents, but they said they are either part of a paternity or divorce. Could they be part of the Marriage Nullity suit although I wasn't aware of it 'til now?

The first step is to determine the status of the petition to anull the marriage was filed. If the marriage was anulled then you must decide whether to have the judgment of anullment set aside or proceed with with a paternity suit.

You should contact an attorney and discuss the advantages and disadvantages of each option.

dont really understand your question. If you were not personally served (or properly served) with the annullment papers, you can have that judgment delcared void. If you are looking for a pre-existing custody or support order, forget it. I doubt your husband would have been that thoughtful or complete. Get (buy) a complete copy of the annullment file and get to an attorney in your area right away. Your right to custody and support is absolute and you should act immediately. good luck.
