Legal Question in Family Law in California

Child Support

I am married to a man in the military who pays $2,100 in child support every month here in California for 3 kids. He is due to retire in 3 years and he would have put in 20 years with the Navy. When he leaves, her child support payments will drop dramatically. I have a home based business in both our names and we are an LLC. My question is: Can she somehow tap into our business funds for child support? I have built a substanial business that i have worked personally so hard for since 1999. I am thinking maybe i should only have it in my name in case she tries to go after monies in our business. Can she? I thank you so much for your time! I really would like to protect myself.

Re: Child Support

If you are both on the business ownership filings then yes she can. Also, she may also request a valuation of the business for purposes of establishing his income from the business, which the court may make your husband pay for at least half.

You must get a QDRO to assure your right to a portion of the pension. You have other issues for which you would benefit from representation. Call me directly at 1.619.222.3504.
