Legal Question in Family Law in California

child support medical care

I have a divorce settlement that requires each parent to contribute 50% of the medical costs. My son, 17 years old, lives with me 100% of the time and is having some medical issues that are quite expensive. I am struggling financially and am not able to cover the 50% any longer while his father is financially well off. We have been divorced about 3 years. Is it possible to alter the agreement to have his dad be 100% responsible until he graduates from high school and is 18? If so, what do I need to do?

Re: child support medical care

You need to file a motion to modify the provisions for the payment of uninsured medical expenses. You may wish to request a modification of child support. Consult with the family law facilitator as to the advisability of filing this motion.
