child support modifiation

I recently had a baby with my new husband and am not going back to work or at least not full time. This will drastically decrease my income. I have been meaning to take my ex-back to court to modify the monthly child support since his income has increased over the years. Since not working full time is a choice (plus it doesn't make sense with the cost of day care), can he use this against me?

There's a couple of things they can do. They can impute income to you, and/or they can take into consideration your new husband's income. His income is community property, and one-half of it belongs to you, technically.
