Legal Question in Family Law in California

Child Support Modification - Out of State

I have a child in CA. I live in ND. I pay child support and half child care that are both garnished from my wages. I would like to change the order so that I could be provided receipts because I believe that the child care costs have gone down. Since I live out of state, how would I go about modifying the order to have the mother be paid by me directly after she provides receipts?

You can file an OSC for Modification, and then do discovery requesting receipts from the day care agency and from the mother. You may not be able to avoid the garnishment, but you could request that the mother give you receipts each month.

You need to file for a modification of the order. It doesnt mean that the current order will be modified unless you can show that it should. As you suggest the modification may come from evidence of need or as you state lack of need.
